Concierge Recommendations and Information: The concierges' comments and recommendations presented on the Site, are based on research and opinions collected by the concierges, and are subject to change at any time. In addition, all responses will be provided based upon REASONABLE research and efforts on behalf of our operators. We do not recommend utilizing our services for financial, legal, tax or other sensitive matters. User Name, Password and Security You are responsible for maintaining the confidentiality of your user name and password, and you are solely responsible for all activities that occur under your user name and password. You agree to immediately notify Red Butler Corp. of any unauthorized use of your user name and Password or any other breach of security related to the Site. Red Butler Corp. Should your membership derive expressly from such a corporate sponsorship, we would provide the corporate sponsor with your general sign up details (address, name, date of sign up details & types of requests placed), but never your sensitive profile information). We use your information on an aggregated basis (not personally identifiable) to do such things as operate our site, enhance our site and sell and deliver messages. We may disclose aggregated information about our users but that information contains no Personal Information. (7) What Kind of Security Procedures We Use to Protect the Loss, Misuse, or Alteration of Your Personal Information Under Our Control Red Butler Corp. takes precautions to protect our users' information. When users submit sensitive information via our website, that information is protected both online and off-line. When our registration and personal profile forms ask users to enter sensitive information, that information is protected using industry-standard SSL encryption. Please note that SSL encryption is sporadically initiated throughout various portions of the site. Not all pages are SSL encrypted, so please be careful what information you submit on our site(s). In addition, please note that Red Butler will also use external sites hosted with other companies which may or may not utilize or similar encryption if any. We hope this policy clarifies our procedures regarding your Personal Information. We will notify you by e-mail of any significant changes and obtain your "opt-in" consent to any significant new uses of your Personal Information, if it was collected from you prior to a significant change in this policy. SERVICES: Concierge: 1.Operators - Operators are available 24/7/365, notwithstanding forces outside of our reasonable control including, but not limited to, natural disasters, strikes, acts of God, governmental restrictions, enemy actions, civil commotions, terrorism, fire or similar causes. Operators are responsible for providing you with informational driven services, limited to virtual telephone oriented operator tasks. Operators will not physically provide any work such as pick-ups, mailings, drop offs, or ANY ERRAND SERVICES WHATSOEVER ... In addition, operators will not provide any secretarial services such checking email, creating spreadsheets or placing postings online. Other than that, we can find, research, book, call, remind, wake up, order online and do just about everything else you'd like for us to do on your behalf. Operators are required to speak English and it is not guaranteed that you will speak with or deal with the same operator each time you place a request. Operators will do their best possible to provide you with the information or task at hand. However, there will be circumstances where such information or far-fetched requests are not fulfilled. Operators will do the best they can to service your requests, but Red Butler Corp. nor its operators will be held accountable, liable or financially responsible for any inaccurate information provided. Should you sign up for our VIP Memberships, you will be assigned to a dedicated team of staff members. These staff persons will be your primary contact points for you to place your requests. Dedicated staff members will be randomly assigned to your account upon signing up for services. You may reach these individuals via the common method of placing requests, however, your dedicated team will be assigned to your requests. Please take note that your individual staff members WILL NOT be available 24/7 (they've got to sleep too). You will be able to reach your dedicated staff team on business days Monday through Friday from 9am - 5pm pacific standard time. For times when they are not available, you will still be able to utilize our services by simply contacting the general concierge and assistants via the email address and telephone number listed in your Welcome Packet. VIP Memberships also allow a second card holder to place requests on your account. Please be advised that the primary account holder's information will be the only information stored on the account. The secondary account holder must be able to provide the primary's member # and verify the account information (email address, mailing address, telephone), etc.. to utilize the account. 2. Monthly Subscription - You will be billed 1 day prior to the beginning of your membership cycle each month automatically. Your subscription will renew automatically once you purchase your membership online and agree to these terms. Please note that your membership will begin from the date you signed up and automatically renew in 30 days. Memberships are not set to renew at the beginning or ending of each month, rather they begin on the day that you activate your membership. Please make sure that you provide a credit card that you plan on keeping, that you have the appropriate billing address information for and that you plan on using for our charges. For any reason, if you want to terminate your account, please visit the "support page" accessible via your my account page for further instructions on how to cancel your membership. As an ACTIVE member, you are entitled to accessing our information and placing your requests. Unused credits and requests DO NOT ROLL OVER. 3. Cancellations - Cancellations are subject to review and must be requested in writing by our cancellation form prior to the next billing cycle. You can download the form by clicking here. Should you cancel any time after the 1st day of your renewed membership cycle, you will be billed for that month. If you sign up for a membership and want to cancel in the same month, you will not be eligible for a refund. We will bill you for that first month and revoke your membership thereafter and ensure that your membership no longer renews. For any reason, if you want to terminate your account, please visit the "support page" accessible via your my account page for further instructions on how to cancel your membership. 4. Personal Membership Pricing - Pricing can change at any time, however you will be notified at least 1 month in advance. Currently our prices for membership are as follows; Basic - $36.95 per month, Plus - $86.95 per month, VIP $165.95 per month). Please note that in addition to our current membership plans, we also offer corporate branded accounts with special promotions. Other individuals may be eligible for specially discounted rates, which you acknowledge and will not have access to. Should you discover alternative pricing for our memberships, you will not be prorated, retro-credited or compensated whatsoever. Please also note that certain memberships require a shipping fee, while others do not. Please also note that our memberships fees may be separated into a shipping cost and a membership cost which will still remain equal to the main membership total (Plus Membership is $86.95, on your online receipt shows $82.00 for membership + $4.95 shipping = $86.95). Your credit card will always reflect the total membership pricing for any given membership level. 5. Promotional Codes - From time to time Red Butler will issue promotional codes which grant %'s off of memberships. While we encourage you to take advantage of our special offers, you cannot request a code or ask for a credit should a new code appear after you have joined up for membership. You may also not abuse our promotional codes in anyway. Such malicious activity would result in legal action and immediate termination of your account. 6. Time of Day - We are a 24/7/365 operation, however some of our services will not be available throughout all of that period. While informational, directional, tasks, wake up calls, reservations, etc.. will be available, some commerce, transactions, refunds, managerial inquiries, or changes to your account, will need to be handled during business hours Monday - Friday from 9am to 6pm Pacific Time. Our telephone number is 310.582-5882. 7. Upgrades / Renewals - Your membership will automatically renew each month. You will not be notified of the renewal. Therefore, you consent and allow Red Butler Corp. to charge your card each month without contacting you in any way, unless you notify us to cancel your account. You will automatically be billed each month, unless you notify us otherwise at least 1 month in advance, please see # 3. You can upgrade / downgrade your account based upon your usage at any time. You are eligible to upgrade or downgrade your account after 15 days have passed since your membership had last renewed. For upgrading you will pay the portion of the new membership, minus the portion you paid for your lower grade membership (From Basic to Plus - $36.95, after 15 days can upgrade to Plus which costs $86.95 for only $50.00). Please note that your upgrade will reflect your credits as follows: Upgrade: You will receive the new total amount of credits for your new membership, minus the number of requests you have used from your current membership. Downgrade: You will receive the total amount of credits available for your new membership, but that amount will not exceed the amount of credits originally issued for that specific membership. 8. Anything, Anytime - Concierge operators will provide Information, Directions, Personal Outbound Calling, Confirmations, Reservations, Wake Up Calls, Travel Arrangements, Directory Assistance and other common information requests over the telephone, by email or by text message. We will provide you with the best information possible that we can ascertain to aid with your request. Should that information we provide be inaccurate, please contact us and we will credit your account for that inquiry. Please note, although we strive to close requests within minutes, we are reliant upon other businesses that may or may not be open. On occasion, requests may not be closed for a day or two, again, depending upon the businesses you are requesting for us to contact, be open for business, enabling us to follow through on your request at hand. If for any reason you think we've taken too long on a request, please send an email to info(@) redbutler.com and one of our membership service specialists may select to credit your request. 9. Credits - Credits are used to monitor the activity of your account. Each membership level possesses its own # of credits. Currently, membership credits are as follows; Basic 15, Plus 40, VIP 100. VIP and Plus memberships receive "request priority" meaning that their requests will be fulfilled first in the order that they are received. The amount of credits for each membership level may change at any time, however you will be notified at least 1 month prior to a change. At the beginning of your membership cycle renewal, we will replenish your account with your total credits based upon your membership level. We will not honor any unused or rollover credits that were not used from the prior month. There is a maximum total of up to 10 credits that may be used on any given day. Should you submit your request on the last days of your current cycle, and your membership renews, credits would first be deducted from your credits at the point of placing your requests. If the number of requests exceeded your previous total amount of credits, we would then deduct from your new total of credits which were replenished when your membership renewed. For each of your requests, we will deduct your account by 1 credit. Any action or search results in a deduction of 1 request. Therefore, if we need to contact your doctor's office to pay a bill, and they need to give us another number to reach their accounting department, we'd deduct your account for 2 credits for making both calls. Please also note that we do offer up to 3 options for inquiries with the same subject which only requires 1 credit. An example of this could be providing 3 restaurants in an area, providing 3 movie times etc... As long as the subject or source of the request is in the same place, we will provide multiples of 3 and reduce your account by only 1 credit. If you wanted us to place 3 separate dinner reservations, that would required for us to reduce your account by 3 credits and so on .... you'll get the hang of it! Therefore, should you call in and request 3 telephone numbers, we will deduct your credit totals by 3. Should you call for 3 telephone numbers, 1 reservation and 7 wake up calls, we will deduct your credits by 11. Any action, any search, any request will result in a deduction of 1 credit as each is treated as an independent action. Confirmations, rescheduling, cancellations, call backs, searches, coordination, multiple destinations will each be calculated as a reduction of 1 credit for each. For multiple requests, such as 3 restaurant suggestions, we will provide up to 3 suggestions to = 1 loss of a credit. If you needed 8 hotel suggestions for another example, we would deduct 3 credits. PLEASE BE CAUTIOUS OF SUBMITTING MULTIPLE REQUESTS WHEN SUBMITTING YOUR REQUESTS. We will not advise you in advance how many credits will be required to follow through on your request. For wake up calls, each wake up call results in a reduction of 1 credit. Therefore if you schedule a week of wake up calls, we will reduce your credits by 7. Should you provide us with the wrong wake up call information, or decide to cancel your future wake up calls, you will not receive those credits back. In addition, Red Butler Corp. will not be held responsible for any damages or liability should you not receive your wake up call. These services are rendered by a digital automated system that can glitch. We will not be held accountable in the unlikely circumstance that a wakeup call is entered incorrectly or is lost. In addition if you run out of credits you can always upgrade your membership. In the event that you need help with 1 or 2 more things, that wouldn't be a problem, we'll always take care of our members at no additional cost. 10. Limitations - By agreeing to our terms, you realize that there are inherent limitations to the services we are to provide. We will not make illegal purchases on your behalf or represent you in any unlawful or illegal way. For purchases made on your behalf by a concierge operator, Red Butler nor its employees or operators will be held accountable for returns, refunds, or guarantees on behalf of the products or services your are purchasing. You are responsible for providing us with your information and there are inherent risks such as fraud, identity theft, wrong purchases, etc.. when allowing an outsider to place purchases on your behalf. Again, we will take all the precautions necessary to protect your information, but we will not be held responsible or accountable or liable for any reason whatsoever should your information become exposed or if you are not pleased with the products or services you approved for us to charge on your behalf. Concierge operators will also not lie on your behalf for any reason or be involved or responsible for any of your personal, business, financial or other actions. We will also not be held accountable or liable in any illegal or fraudulent activities that you impose or request upon our services. In such cases, we will terminate your account immediately and report you to the local authorities. 11. Usage Restrictions - You also agree that you are not to abuse our Operators, our time or our services in any other way outside the scope of our Concierge Services. You are not to resell our services, forward calls to your friends or relatives, exchange membership cards or Spam our operators will fraudulent and erroneous requests and inquiries. Such actions will result in immediate termination of our account and additional charges for our lost time. In addition, you are not to utilize our operators or Concierge services to profit your business or personal finances in any way. Our operators will not honor fraudulent outbound calling, money collections, prank calling or other illegal activities. 12. Time Limitations - While there are no time limitations to our calls, please keep in mind that to better service all of our clients we would appreciate your prompt inquires. Operators will not remain on hold for long periods of time, or virtually ride along with you until you reach your final destination. We anticipate that most calls will commence from beginning to end in approximately 2-4 minutes. If required we will divide the requests 20 minutes = 1 credit. In addition, for ASAP requests, we advise that you make such requests via telephone. The second fastest method of requests is via email and for requests that require extensive research, we recommend submitting your requests via your my account page. 13. Automatic Billing - Your account will automatically be billed each month 1 day prior to the beginning of your account cycle. If you join 11/19, the next charge will be 12/17 but your account is active until 12/18 at the beginning of each month. Your records will indicate your appropriate membership level charge. Should you have any billing questions, please contact us immediately. Your billing statement will reflect a charge from Red Butler or LA Butler (our parent company), along with our toll free number for questions. On occasion, your credit card's automatic renewal may fail resulting in a "do not honor" or "funds exceeded" message which would not allow our system to renew your membership. In such an event, you authorize and allow Red Butler to manually process your credit card at a later date to renew your membership. Please note that in doing so, your membership cycle would also be affected and begin to renew from the new date that we were most recently able to process your card. In addition, if your credit card fails, you authorize Red Butler to utilize an alternate credit card's information, which you submitted on your account, in order to keep your membership active and set up for future membership renewals. 14. Refunds - There will be no refunds for services that are rendered. As mentioned above, to cancel services we must be notified in writing by filling our the cancellation form one month in advance. The current month will be billed for services accordingly, whereas the following month will not. Credits will be refunded only if there was an error committed by a Concierge Operator. In that case, please notify the operator that they had provided you with the wrong information and they will then provide you with the correct information and credit your account by 1. There will also be no refunds for purchases made on your behalf. When you ask for our representatives to make purchases on your behalf, we will not be held accountable should the product or service your are purchasing not meet the expectations you had in mind. Please review on your own, all refund and exchange policies with the service providers you intend for us to make purchases on your behalf, PRIOR to asking that we make any purchases for you. We will not be held accountable, liable or responsible in anyway for purchases on your behalf that are lost during shipping, tickets arriving late, goods damaged in the mail, etc... We will make purchases on your behalf simply to save you time, but in no way will be responsible for the goods or services we are purchasing. 15. Intoxication / Respect - As a Concierge Member you also agree to respect and be decent with our Concierge operators and staff. Calling intoxicated, drugged or utilizing profanity or derogatory language in anyway is not permitted. At any time, our Concierge operators have the right to hang up on you or cancel your membership should you fail to be respectful or treat our staff members with the same level of professionalism and courtesy they treat you with. WE RESERVE THE RIGHT TO REFUSE SERVICE TO ANYONE AT OUR DISCRETION. 16. Outbound Calling - While our operators will provide outbound calling on your behalf, this service is limited to calls within the United States. Outbound calls are merely to communicate quick pieces of information to a 3rd party, such as appointment scheduling, confirmations, call backs, leaving voicemails, etc.. Outbound calls will not include conference calling, or personal and sensitive calls; breaking up, money issues, private issues. If you're in that sort of a jam, you're probably better off making the call yourself. In addition, Red Butler Corp. nor its operators will be required to keep a log of your telephone calls, rolodex and will not save your telephone numbers. You must present the operator with the telephone number you would like to use at the point of the request. You also agree that in some cases such as purchases and appointments, Red Butler Operators will need to speak on your behalf, enter your personal information to create profiles (Amazon.com for example), and you authorize for us to use your personal profile information to get the things done that you are asking for us to do. 17. Membership Cards - see below 18. Liability - Our hospitality services offer supplemental services to your personal needs. Red Butler Corp. nor its operators or staff will be held responsible for any reason whatsoever as the result of our services. You agree that should any damages resulting from our informational or general services take place, you revoke your right to pursue any legal action. We will do our best to provide you with sound and accurate information, but should our information lead to your dissatisfaction with the vendor or service or result in action provided, you will be held accountable. 19. 3rd parties - Due to Red Butler Corp.'s vast line of services, we have the right to utilize 3rd party companies to provide you with the best service possible. Such 3rd parties include, web designers, marketing teams, call centers, residential vendors, marketing consultants, public relations firms, graphic designers and more. In addition you agree that for certain purchases or specific online bookings will result in a commission based link share stream for Red Butler Corp.. 20. Travel Arrangements - Travel Arrangements are also offered as part of our services. Red Butler Corp. will try to find you the best deal for air travel, hotel accommodations, limo services, etc.. We will not be responsible any way and do not represent the quality or vouching of any of these service providers. As the customer, you are accountable for the final selection of your destination or service provider. If you are not pleased with any services referred to by our operators, please contact the service provider rather than Red Butler Corp.. Once we place make a purchase or place an order for flights, hotels, or any other travel related services, we will not be held responsible for any refunds or disputes. It will be your responsibility to inquire upon any cancellation rules prior to booking and dispute any concerns you have directly with the service provider. Red Butler will not refund, credit or be held responsible whatsoever for any travel related purchases. 21. Text Messaging - from time to time, an Operator may offer to text you the information you are looking for. Whether you are looking for movie times, directions or a telephone number, we'll send you a text message. You agree that by saying yes to receiving the text message, you will most likely be charged by your cell phone company. Red Butler Corp. will not reimburse or be responsible for your text message charges. 22. Research - Also included in our services are research typed inquiries. Such requests are limited to searches for places and things. We will not try to find people or ancient artifacts. Please be reasonable with your request. Research requests will only be carried out during business hours. Please allow at least a few hours or days to provide you with the best information possible, depending upon the scarcity of your request. 23. Gift Memberships - If you were provided with a Gift Membership it is required that you activate your membership within 12 months from the date of purchase. If you have not activated your membership in less than 12 months from receiving your gift membership, you will not be eligible for use of our service. Please note that your gift membership will expire within a predetermined period of time. Our membership are sold in periods of (3 months, 6 months, or 1 year, etc... You must utilize our service during this ACTIVE period of time as unused requests will not be made available for use or refunded whatsoever upon expiration. ALL SALES ARE FINAL. 24. Everything Else - We appreciate your business and want to provide you with the best Rewarding Lifestyle possible. We will do our very best to service you. Should you encounter a problem please just let us know. By agreeing to our terms you too promise to be reasonable and considerate of our business and services.
Membership Card: 1. Mailing - Your Personalized Concierge Card will be mailed to you along with your Welcome Materials approximately 3 - 5 business days after submitting your order. Your membership card will list your name, randomly selected member # , membership type and "valid through" date. We ask that Basic Membership card holders only utilize the service upon receiving their welcome materials and new Personalized Concierge Cards. All cards will show a valid through date based upon the current year when the membership was activated. From that point forward, all ACTIVE members will receive a new Concierge Card in the mail free of charge each New Year. If you have a valid card, but don't have an Active membership, you can still use our card to obtain local discounts. Invalid cards (cards with valid through dates that have expired) will not be accepted at our participating local discount providers. 2. Upgrades / Downgrades - Since your membership card reflects your membership type, should you upgrade or downgrade services we may issue you a new card. If you would like a new card printed, please contact us. 3. Lost Cards / Replacements - Should you lose your card or would like one replaced, the charge for the card is $10.00. You may not add additional cards to your account for other users to reap benefits of the cards. There is a maximum of 1 card per membership. Likewise you may never try to reproduce the card. The Red Butler Corp. membership card is tagged with a magnetic strip with your data and can be swiped at any time by local discount providers for authentication. 4. Usage - You may use the Red Butler Corp. Concierge Card as proof that you are a Red Butler Corp. Concierge Member. You may also use the Red Butler card to utilize any of local discount network offerings. Please refer to the You may not use the card for any other reason. 5. Misprints - Should you receive a Concierge Card that has been misprinted by our staff we will replace it at once at no charge! Please make sure that when you register your name and information online after signing off on this agreement that your information is exactly as you would like it to appear on your card. We will use that information to print your card. 6. Local Discounts - see below Local Discounts: The Red Butler Concierge Card is not a credit card. It is a physical representation of your membership with Red Butler. You can use this card to obtain discounts and other benefits at Active local discount participating locations. Use of the Membership signifies acceptance and understanding of these terms and conditions. The Red Butler Concierge Card will be accepted by businesses listed in our local discount network. Cards with displaying a current "valid through" date will be accepted. Should an "non valid" Concierge Card be presented at one of our local discount providers, the establishments will not accept the card. Please check the discount chart online at www.RedButler.com prior to visiting a local discount provider. Each location and establishment has its own rules and various limitations on the acceptance of the card. When using the discount chart, read each listing carefully and thoroughly, and respect the merchants' participation and employees by not requesting exceptions or substitutions to advertised offers. - Businesses reserve the right to exclude happy hour, take-out, deliveries, and groups larger than six people, special events and holidays. Discounts cannot be combined with any other offer or promotion and exclude tax and gratuity. - When tipping, we ask that you base your tip on the entire check before you Red Butler Corp. Concierge Card discount. This is a true reflection of your satisfaction with the service and your generosity will assure their cheerful and continued participation in the program. - Present your Red Butler Corp. Concierge Card before the bill is totaled (and in the case of car repair shops, before the estimate is made) so the employee does not have to void the initial transaction. - Discounts do not apply to alcohol. (Various State laws) - The list of merchants participating in the program is constantly changing. Due to circumstances beyond Red Butler Corp. Concierge Card's control, merchants periodically drop from the program or change their discount offer. At the same time, new businesses may join the program. For the most updated listing, please refer to the website. If the merchant does not appear on the website, it is no longer in the program. You are not entitled to a discount if a merchant has dropped out of the program, so be sure to check the website frequently. By purchasing and using the Red Butler Corp. Concierge Card, you agree to the evolving nature of our participating restaurants. - In the event that a participating merchant changes the discount offer or does not honor the Red Butler Corp. Concierge Card membership for any reason, Red Butler Corp. Corp., will not be held responsible. This may occur because of change of ownership, management, or a misinformed employee. However, Red Butler Corp. Corp., will use reasonable efforts to attempt to secure the merchant's compliance with the program. Wake Up Calls 1. Number of Minutes - Each wake up call is worth 1 credit. Therefore should you request an entire month of wake up calls, they will reduce your credit totals by 30. Credits are replenished at the beginning of each month. If you want to cancel future Wakeup Calls, you will not receive those credits back. 2. Calculation of Minutes - Each wake up call is worth 1 credit. 3. Inconsistencies - Should an inconsistency or error take place by Red Butler Corp.'s staff or Operators, cancellation of future wake up call will be cancelled and your credits will be replenished. 4. Monitoring - You agree that Red Butler Corp. has the right to keep track of your wake up calls or and monitor your usage to ensure appropriate credit reductions. 5. Sounds - You have the option to select from various songs or sounds to wake up to. While we'd like to offer your hundreds of sounds and songs, currently we offer a handful. Please make sure to tell your concierge operator, which sounds you would like. If you select to have numerous wake up calls at a time, please note that the sound you select will be applied to all of them. We will not be able to cancel and reissue new sounds should you plan on changing your mind. 6. Extra Fees - Should you plan future wake up calls and run out of credits, your wake up calls will be cancelled, or you will have to purchase more credits. Likewise, you will only be allowed to purchase future wake up calls, contingent upon how many credits you have in your account. Therefore, if you have 5 credits and need 7 wake up calls, you will only be able to schedule wake up calls for the following 5 days. You will not be able to call in for other Anything, Anytime requests, since you would have used up all of your credits for the month. 7. Appropriate / Inappropriate Usages - You may utilize wake up calls for your own personal use. You may not utilize wake up calls to schedule calls for other people. You may also not utilize wake up calls to prank or annoy other people or businesses. You may not resell our services and you may not request abusive or pornographic messages to be sent via our operators. 8. Liability - You agree that wake up calls are sent digitally and are sent via a systematic computer system. There may be glitches in the system and therefore, Red Butler Corp., it's staff or it's operators will be held accountable in a rare instance that a wake up call is not delivered. Should you miss an appointment, lose a financial opportunity, miss a flight or are negatively affected by a missed wake up call, we will not be held responsible.
